 The Supreme Court has not yet decided on the appeals made within the court about the judgment on trials where civilians are tried by the military.



On Wednesday, the Supreme Court didn't give a decision yet on some appeals made within the court. These appeals challenge the unanimous decision made on October 23 regarding military courts.

On October 23, a larger bench of five members declared military trials of individuals arrested after violent protests on May 9 null and void. During the recent hearing, Justice Masood, part of the bench, refused to step down despite objections.

The objections were raised regarding his presence by Advocate Latif Khosa, citing a notice issued to Aitzaz Ahsan. Justice Masood insisted arguments could proceed before issuing a notice and referred to a past decision by Justice (retd) Jawad S Khwaja.

Attorney General Mansoor Awan deemed objections baseless, urging the bench to hear the case on merit. The appeals involve the caretaker federal government, defense ministry, and interim provincial governments. Despite objections, the court started hearing the appeals, asking objecting counsels to take a seat.

This development follows the Supreme Court's announcement of a six-member larger bench, led by Justice Sardar Tariq Masood, to oversee the appeals. In a separate move, Justice Ijazul Ahsan raised objections over the formation of benches for high-profile cases, calling for seniority considerations.

Former CJP Jawwad S Khawaja also filed an application for Justice Sardar Tariq Masood's recusal, citing past events and expressing concerns about the interest of justice.
